When a Physician Side Gig Goes Horribly Wrong
I spoke earlier this year with Dr. Nisha Mehta and my former client Dr. Benjamin Toh about how a side gig went horribly wrong. Dr. Toh took a side job reviewing charts for patients whom he believed wanted and needed genetic tests, but he unfortunately was accused by the government of conspiring to commit health care fraud and to violate the Anti-Kickback Statute. My trial partner Joy Longnecker and I were able to show that the government had misinterpreted a key legal element, and Dr. Toh was not convicted of health care fraud, but he was still found guilty of a lesser charge and served time in federal prison as a result.
